CIVIC GOVERNMENT (SCOTLAND) ACT 1982 – PRIVATE HIRE CAR DRIVER’S LICENCE – N CASE 14 The committee was invited to consider a report (which had been circulated) by the Chief Solicitor, which advised that Lothian & Borders Police submitted a request to suspend the private hire car driver’s licence. The report recommended that the committee consider the implications for the licence holder’s licence in light of the request by Lothian & Borders Police. The committee heard the Senior Solicitor and Lothian & Borders Police speak in relation to the report. The committee was advised that the licence holder had been charged with being in possession of a controlled substance and subsequently convicted. The licence holder and the committee was given an opportunity to question the Senior Solicitor and Lothian & Borders Police. The committee heard the licence holder speak in relation to the report. The licence holder accepted the facts of the report, his later conviction for possession of cannabis, and admitted to occasionally using a controlled substance to help him sleep. He also (the taxi driver who's just been convicted processing drugs advised this committee that he no longer taken drugs ) and was willing to submit to a medical examination. The Senior Solicitor, Lothian & Borders Police and the committee were given an opportunity to question the licence holder. Each side summed up before the committee deliberated the merits of the case. The committee found that there was a case to answer requiring it to consider suspending the licence, and that in light of the information before the committee in relation to the conviction for possession of cannabis and the licence holder’s own admission to having used cannabis in the recent past, it was appropriate for the licence holder to undergo a medical examination before being able to use his licence again. Following deliberations all parties were given a further opportunity to provide information that would assist the committee determine if the licence should be suspended and the appropriate duration of any suspension. Decision 1. To agree, that in terms of Schedule 1, Paragraph 11(2)(a) of the Civic Government (Scotland) Act 1982, that the licence be suspended for a period of one month, as the committee was of the opinion that the licence holder was no longer a fit and proper person to be the holder of the licence. 2. To agree, that in terms of Schedule 1, Paragraph 11(2) of the Civic Government (Scotland) Act 1982, that the licence be suspended until natural expiry or until the licence holder was passed a medically fit to drive a private hire vehicle as the committee was of the opinion that the carrying on of the activity to which the licence related was likely to cause a threat to public safety. 3. That the licence holder’s private hire car driver’s licence be suspended with immediate effect under Schedule 1, Paragraph 11(10) of the Civic Government (Scotland) Act 1982. 4. To delegate authority to the Chief Solicitor to restore the licence after the first month’s suspension period in the event that the licence holder was certified by the council’s medical examiners as fit to drive in terms of the standards set out in the Medical Commission on Accident Prevention’s publication entitled “Medical Aspects of Fitness to Drive |
