the tribunal judges acting with clear racism instauration supported by the scottish government new racism policy and instruction otherwise they will never dare to do what they did in this case

they deny and claim they ignorance about illness and also pretend they ignorance about simple knowledge

recently a colour person has been suffered from a racial abuse and assault was one of the reason of an illness called functional weakness,the illness effect his right side arm and leg with too may other symptoms such as headache and dizziness and hard movement,when he applied for disability allowance was shocked as he been refused and he appeal against hopping for more professional doctor who do understand his illness but he was wrong it is not just an ignorances doctor but they by far the most races people you can meet and her what happen

the applicant attend with walking disability using a crutch with this his left hand side to support his weak right side ,the following is his letter which it has been sent out asking for a permission to appeal he upper tribunal which also been refused )

Dear Mr T. Lunney

I am asking to consider my request to appeal to the upper tribunal and investigating my complaint

there is very clear evidence to support my complaint and my suggestion regarding the doctors discrimination for my illness and race

the following explanation will provide too many reasons why I am pointing to a very clear illness and race discrimination or not a qualified doctor

1- I have been treated totally unfairly and have never been embarrassed, humiliated, and insulted like this day in my whole life in front of all the tribunal members and my representative from the advice shop Mr ...... by the tribunal doctor who seems very aggressive from the first minute and started her question by why are you using a crutch ? I can't see any reason why you are using a crutch, I did give a very clear answer and fully explained my health condition which I do suffer from a Functional Weakness and my right leg and arm are very heavy and I can hardly move my leg and also my balance is not great and also loose of sensation as my arm and leg are numb most of the time .

The Doctor in an aggressive tone said SO ANY ONE CAN HAVE SOME WEAKNESS THAT DOESN'T MEAN WE` WALK WITH CRUTCHES,

and again I did explain it is not a normal or a simple weakness and what I am suffering from is an illness called Functional Weakness which was diagnosed by a neurologist Ph.D. Dr ....  who is specialised in Functional Weakness illnesses and has his Ph.D. in this field ,and did give a very clear explanation about my illness

as follow, Functional Weakness it is a weakness of an arm or leg or both due to the nervous system not working properly. Also I did explain clearly that any Patient with functional weakness experiences problems walking or a ‘heaviness’ down one side, dropping things or a feeling that a limb just doesn't’t feel normal and also loose of sensation plus too many other symptom and it is been going on for long time as it s symptoms are similar to a stroke also I did explain that my right leg and arm are too heavy, numb most of time and I am moving my right leg very hardly.

After all of the above explanation the Dr said that doesn't mean you need a crutch to walk and looking that you have a very heavy leg by using the crutch !!

Why would a qualified Dr pretend and ignore my illness in front of the other tribunal members giving them the impression that there is nothing called a functional weakness by the aggressive reply to my explanation regarding my illness and said so any one can have some illness, and would it be possible that a qualified Dr never learned or at least even heard about a functional weakness illness sure not as any beginner doctor will know the Dr ... gave a very clear impression in front of every one at the tribunal service that I am only pretending and there is no such an illness and I am only making it up which is for sure not true in all means, over a year i have been suffering from Functional Weakness which is something that has been clearly clarified by Ph.D Dr and full report were already provided to the tribunal  ,

after too many scans and investigations by a specialised neurologist Ph. D .......

I was totally shocked while reading the doctor reasons for refusing my appeal which is very clear evidence and proof of discrimination to my disability and race, in the report  the Dr  lie and stated that I didn't give an answer to her questions why I am using the crutch and not just that she even never mentioned a word regarding my illness and said in other question that I never gave an answer again while I did clearly stated that I am suffering from a Functional Weakness but she never mentioned a word in the reasons report regarding my illness nor my response or even the Neurologist report who did clearly diagnostic my condition as a Functional Weakness , after all of that  in the refusal report she stated that the doctor was satisfied that the use of the crutch is not needed for my walking purposes so the Neurologist report and the physiotherapy i am getting is been ignored in which i believe  it is  a very clear evidence that the doctor has passed out her view to the other tribunal members who are not qualified doctors and for sure they believe her professional explanation as she the only doctor members at the meeting which is another explanation as to why I am pointing to the doctors discrimination or not qualified as a doctor as any beginner doctor will know.

it is a shame to see a Tribunal member who should acts as a judge to lie and hide the truth because of her discrimination to my  race which is more than clear at the tribunal meeting and from here refusal answers,

2- question any qualified doctor should know,

it is very clear in my file that I have suffered from a car crash back in 2005 that left me with damage to my spinal cord The damage I had from the accident was as stated by the doctor in page 58

1- T9 T10 Avulsed spinous process

2- T11 wedge fracture

both segments T9 and T10 have been squashed into each other which is something nothing can be done to fix, and has been clearly explained to me by the doctors and I also clearly explained it in front of the tribunal members by the hospital and doctors reports, such a damage in the spinal cord will remain painful for the rest of my life and such a damage to spinal cord will never go back to normal, any qualified ,beginner doctor or even non doctors will know that after healing of such a spinal damage the pain will remain and there is nothing that can be done as there is no medical solution or surgery that can fix such a damage , more than 5 doctors from the health centre have been issuing a very strong pain killer for the last 4-5  years every 4 hours and will remain to the rest of my life, any one with this kind of damage will suffer pain for the rest of his life in his legs more than the back as it's pushes the pressure down to the legs when standing due to the spinal damage which makes it more harder to stand or walk for a long time, the Doctor surprisingly asked a few times it says here in your DLA form that you have pain to your legs I can't see why ?? WHY

a very strange question to be asked from a qualified doctor which also explains the doctors intention of passing a clear message to the other tribunal member as there is no reason for my pain,

however with clear answer to her question I did explain it very clearly it is because the damage I had to my spinal cord which keeps a pressure into my legs all the time and that is very normal in such a circumstance any one who did suffer from similar spinal damage will always get a very bad pain plus the new reason which is functional weaknesses and explained my self again about the condition of this illness as above,

again and again  I am pointing to the doctors discrimination or not qualified doctor as she did pretend again in front of the tribunal members that my pain is unreal and there is nothing wrong with my back or legs and such a damage to spinal cord shouldn't leave any pain as the fracturers should be healed and the damage no longer there  which for sure is not true in all means and prove her lying reasons .

After my explanation the doctor said again I don't know what is wrong with your legs ??

and again for the fourth of fifth time  I did explain myself again and again due to the spinal damage and functional weakness  and pointed out to more than  30 tablets of pain killers and others medication I have been taken for the last 4 years until now plus other new treatment and medication due to functional weakness ,

as the other tribunal members are not a doctors the Dr ignored the fact and made it look like I am pretending and there is nothing wrong with my legs or back, making every one at the appeal day understand from her reply by ignoring my health condition that I have nothing and only pretended the pain and sickness which is for sure not true and also proved the Dr intention and discrimination

3- another aggressive respond when the Dr asked me how did i manage to carry a wheelchair in your taxi while I was working as a taxi driver and i responded that I never did and for sure I can't , I used to drive a saloon car not wheelchair accessibility car plus i was working as a private hire driver which it it has to be ore booked through the office and if there is any needs to a wheelchair care they will ask for it,but normal saloon car which does not have a ramp or even a place to carry a ramp and the Doctor responded,I AM SURE ALL TAXI DRIVERS MUST CARRY WHEELCHAIR.

I explained I used to drive a saloon car not a wheelchair access car which has no space for a ramp to carry a wheel chair on it and she responded again I AM SURE ALL TAXI DRIVER MUST HAVE A WHEELCHAIR RAMPS she is simply shown her discrimination very clearly and not just try to pretends she don't know any thing about human health but she also showing her clear racism against any thing i says and without even thinking about what she says

AND AGAIN AND AGAIN I don't drive wheelchair access car it is a saloon car how can any one use a ramo within a saloon car and for sure I can't carry a wheelchair any way and under any circumstance,

as with all the Dr answers and replies giving the impression to the other tribunal members that I am lying and not saying the truth , which is again not true at all but only explains and gives a very clear image regarding the doctor manner and reaction to every word I am saying by twisting the truth even when for sure the Dr is not qualified as a licence officer to make just a comment against my answers but gives a very clear evidence regarding the Dr racial and discrimination to my self only because of my race and illness .

4- the Dr wrote the refusal reasons with a very clear fact of discrimination for my disability and race, made another proof of the Dr manner.

the doctor was writing the refusal reasons with 100% confident that no one is going to read the reason or I may not understand what she says and start picking any points and twist it against my self .

the doctor stated that I did say I may go out every 6-8 weeks and pointed that I am lying as I am working as a taxi driver and going out to work every day

Question at P28 as follow

Q Do you usually need help from another person to take part in HOBBIES ,INTEREST, SOCIAL OR RELIGIOUS ACTIVES

So the question has nothing to do with working purpose and I am not a lire as the doctor clime, simply she is trying to twist every thing against my self for her racial and discrimination reasons , plus the Dr stated that I have been working every day as a taxi driver again the doctor made this up from no where as it is stated clearly in my appeal that I was working part time but again made up stories that I worked full time and this is not true , i never ever said so any way,

I only managed to work for 16 hours a week this information can be obtained from HM Revenue.

Another point regarding my walking ability which is clearly stated by Dr Ad....  on page 66 clearly stating that I can't walk in the supermarket and my wife does all the shopping ... again she has twisted it and claimed i stated to th Dr A... i do shopping my self which is also not true and neither i or DR A..... stated so

all the above information explained why I suggested either the person is not a qualified doctor or a very racist person and in this case when the person is a qualified doctor then the reasons are very very clear which discrimination for my disability and race .

1-giving wrong and misleading explanation to the other tribunal member.

2-use her power as a tribunal doctor and twisting the truth

3-ignoring my illness and condition along with my evidence

4-acting unfairly and unreasonable manner

5-fake and twist the fact on her refusal letters

6-making up an incorrect evidence against myself

along with getting embarrassed, humiliated, and insulted in front of every one in the room by suggesting I am not saying the truth and pretending the illness, for sure I don't deserve so and no one deserve so because of they illness or race

I have been honest and straight forward in all my answers, responds and evidence regarding my health condition and only Looking for justice

LOOKING FOR JUSTICE SO SORRY TO SAY LOOK FOR IT SOMEWHERE ELSE IF THIS PEOPLE KNOWS WHAT IS JUSTICE MEANS THEN THEY WOULD NEVER DID SO TO YOU IT IS RACIST ORGANIZATION SUPPORTED BY RACIST GOVERNMENT
